TERMS AND CONDITIONS OF SERVICE

Welcome to the “AI Christmas Postcards” campaign (hereinafter, the “Service”), offered by the Gran Canaria Tourism Board (hereinafter, “Turismo de Gran Canaria”).

These Terms and Conditions of Service (hereinafter, the “Terms”) govern access to and use of the web platform. By using the Service, you (hereinafter, the “User”) accept and agree to comply fully with these Terms. If you do not agree with them, please do not use the Service.

 

1. PURPOSE OF THE SERVICE

The Service allows Users to generate a personalized Christmas postcard using their own image, which is processed by an artificial intelligence (AI) system to integrate it into a predefined background featuring a point of interest in Gran Canaria.

The use of the Service is free of charge and has an exclusively recreational and promotional purpose.

 

2. TERMS OF USE AND USER OBLIGATIONS

The User agrees to make appropriate and lawful use of the Service and, in particular, undertakes to:

  • Be of legal age in their country of residence or, if a minor, have the express consent of their parents or legal guardians.
  • Not use the Service for unlawful, illegal purposes, or in a manner contrary to good faith or public order.
  • Not upload images containing violent, pornographic, racist, xenophobic material, content that incites hatred, is defamatory or slanderous, violates third-party rights, or infringes intellectual property rights.

 

3. IMAGE RIGHTS AND CONSENT

By uploading an image to the Service, the User declares and warrants, under their sole responsibility, that:

  • They are the legitimate holder of all intellectual property and image rights to the photograph, or have the express authorization of the holders of such rights.
  • If third parties appear in the image, they have their express consent for the use and processing of their image.
  • If minors appear in the image, they have the explicit consent of the minor’s parents or legal guardians.

 

The User shall hold Turismo de Gran Canaria, Flecher.co, and their providers harmless from any third-party claims.

 

4. INTELLECTUAL PROPERTY OF THE GENERATED CONTENT

Original Image: The User retains all intellectual property rights over the original image uploaded to the platform.

Generated Postcard: The User is granted a limited, non-exclusive, worldwide, and free license to use the generated postcard exclusively for personal and non-commercial purposes.

Prohibitions: Any commercial or advertising use of the generated postcard is expressly prohibited.

Watermark: The generated postcard will include a watermark with the text “Generated with AI”. The User agrees not to remove, alter, or conceal this watermark.

 

5. DISCLAIMER OF LIABILITY

The Service is provided “as is” and “as available”. Turismo de Gran Canaria does not guarantee uninterrupted availability of the Service or the absence of errors.

Turismo de Gran Canaria shall not be liable for:

  • The content of images uploaded by Users or any potential infringement of rights.
  • Any improper use that Users or third parties may make of the generated postcards.
  • Any artifacts or errors generated by the AI model.
  • Any damage or loss arising from the interruption or malfunction of the Service.

 

6. PERSONAL DATA PROTECTION

The processing of the User’s personal data (image, email address, etc.) is governed by the provisions of our Privacy Policy, which forms an integral part of these Terms.

 

7. AMENDMENTS AND APPLICABLE LAW

Turismo de Gran Canaria reserves the right to amend these Terms at any time. Any amendments will be published on this same page.

These Terms shall be governed by and construed in accordance with Spanish law. For any dispute, the parties submit to the jurisdiction of the Courts and Tribunals of Las Palmas de Gran Canaria.
